Terms and Conditions of Sale

The online store massimolentsch.it is owned by Società Agricola Fuori Bolla S.r.l., VAT: 05603620872, with registered office at RANDAZZO SP 89 S.N. – 95036 – (CT), registered in the Companies Register under number REA 413300 (info@massimolentsch.it). massimolentsch.it is an online store that offers the sale of beverages.

The General Conditions govern all contracts concluded between the parties and form an integral part thereof. The general contract conditions may be modified from time to time, taking into account any regulatory changes. The new general contract conditions will be effective from the date of publication on the massimolentsch.it website. The supply of alcoholic beverages is reserved exclusively for customers of legal drinking age. THE SALE OF ALCOHOLIC PRODUCTS IS PROHIBITED TO MINORS.

Users of the massimolentsch.it website declare that they are of legal drinking age according to the applicable legislation. If there is no legislation in this regard, it is necessary to be at least 21 years old.
The products available for purchase are intended solely for end consumers. A consumer, according to the definition provided in art. 3 of Legislative Decree no. 206/2005, is a natural person who acts for purposes unrelated to any entrepreneurial, commercial, artisanal, or professional activities they may carry out. Therefore, the Seller reserves the right not to enter into contracts with parties who are not consumers.
The language of the Contract and the General Conditions is Italian.

Prices

All prices quoted are inclusive of VAT and may be subject to change without notice.

For orders from outside the country, please note that prices do not include any taxes, duties, or customs charges of the destination country. If such costs apply, the customer is responsible for verifying the amount in advance with the local customs authorities and assuming the associated expenses.

Product Availability

All products available on massimolentsch.it are actually in stock at our warehouses. However, the actual availability of a product is indicative as multiple users may purchase it simultaneously. The website is updated multiple times a day.

In the event that a customer orders an unavailable product, massimolentsch.it will immediately notify the customer and provide a refund.

The product photos on massimolentsch.it are purely indicative and do not guarantee the quality of the product. Some photos may show gift packaging or boxes that may not be included unless specifically requested. Some photos may depict vintages that do not necessarily reflect the actual vintage of the product. The definitive vintage is always the one indicated in the product description.

Order Placement and Shipping

To make purchases on the massimolentsch.it website, users are not required to register, but they must provide all the contact and shipping information requested in the order confirmation form and explicitly accept the privacy policy and these conditions.

Each order submitted represents an independent purchase proposal and is subject to availability and discretion of massimolentsch.it. If the requirements for processing an order are not met, massimolentsch.it will immediately notify the customer and provide a refund.

The customer has the right to cancel an order at any time before the merchandise is invoiced and handed over to the courier by providing written notice via email to massimolentsch.it. After the courier has taken possession of the merchandise, the customer may exercise the right of withdrawal (see the specific section).

Upon order confirmation, which constitutes acceptance of the contractual proposal, a fiscal document will always be issued in accordance with the current legislation (receipt or accompanying invoice, the latter if requested at the time of order confirmation), and it will be made available online in the customer’s personal area (“My Account”). A summary of the applicable general conditions, including information on the right of withdrawal, will also be provided in PDF format. If the order is paid through the Amazon Pay gateway, it is not possible for us to retrieve all the necessary data from Amazon to issue an invoice; in this case, a receipt will always be provided to the customer.

Shipments are covered by insurance. Any breakages or anomalies found upon receiving the product must be noted on the courier’s delivery document and promptly reported to us at info@massimolentsch.it, preferably with photos and references to the order number, courier name, and shipment number.

The estimated shipping times indicated in the shipping section are purely indicative. massimolentsch.it is not responsible for any issues faced by customers due to delivery delays.

Customers who are “Consumers” have the rights granted to consumers under Article 130 of Legislative Decree no. 206/05; these rights must be exercised within the terms specified in Article 132 of the same Legislative Decree 206/05.

Right of Withdrawal

Purchases made on the massimolentsch.it website are subject to the regulations of Legislative Decree 206/2005 as amended by Legislative Decree 21/2014, which guarantees the consumer the right to withdraw from the purchase contract for any reason.

The consumer who wishes to exercise this right must be aware that the purchased goods must be in their original and intact condition in order to exercise this right.

To exercise this right, the consumer must send a proper communication within 14 days of receiving the merchandise, indicating the order number, fiscal document number, and details of the products for which they intend to exercise this right. The consumer must then proceed to return the products within the following 14 days. The communication of withdrawal can be sent via email to massimolentsch.it or by post to Società Agricola Fuori Bolla S.r.l. – Massimo Lentsch, SP 89 s/n – Randazzo (CT) 95036 – Italy. In the withdrawal communication, the consumer will indicate their intention to exercise the right of withdrawal and refer to the Order that gave rise to the Sales Contract from which they intend to withdraw.

The right of withdrawal is reserved only for end consumer customers, excluding purchases made by individuals who buy for the purpose of resale to third parties.

Shipping costs and methods are entirely borne by the customer, including any suitable packaging. In the case of returns from non-EU countries, any customs charges related to returning the goods to Italy are the customer’s responsibility.

The merchandise must be returned to the following address: Società Agricola Fuori Bolla S.r.l. – Massimo Lentsch, SP 89 s/n – Randazzo (CT) 95036 – Italy. massimolentsch.it reserves the right to evaluate the returned merchandise to exclude any alterations, damages, tampering, or any other issues that may have compromised the integrity of the product.

If the right of withdrawal is exercised in accordance with the methods and terms stated in this article, the Seller undertakes to reimburse all Payments received from the consumer customer as soon as possible and in any case within 14 calendar days from the date of receipt of the withdrawal communication. The Seller may withhold the reimbursement until the Product is received or until the customer provides proof of having returned it, depending on which situation occurs first. The reimbursement will be made after evaluating the complete integrity within 14 calendar days. The customer will be refunded using the same method of payment used for the original transaction (credit card, PayPal, bank transfer); if this is not possible, a refund will be made via bank transfer.
The consumer customer will be responsible only for any diminished value of the Product resulting from handling the goods beyond what is necessary to establish the nature, characteristics, and functioning of the Product itself.
The exercise of the right of withdrawal is excluded in the cases provided for in Article 59 of Legislative Decree no. 206/2005 and subsequent amendments. By way of example, but not limited to, the following cases are excluded from the right of withdrawal mentioned in the previous article: the supply of goods that are liable to deteriorate or expire rapidly; the supply of sealed goods that are not suitable for return due to health or hygiene reasons and have been opened after delivery; the supply of alcoholic beverages, the price of which was agreed upon at the time of concluding the sales contract, and the delivery of which can only take place after thirty days, and the actual value of which depends on fluctuations in the market that cannot be controlled by the professional.

Disputes and Jurisdiction

The sales contract between the customer and massimolentsch.it is deemed to be concluded in Italy and governed by Italian law. Any issues relating to the contracts will be subject to Italian jurisdiction. In the case of consumer customers, for all disputes arising from this contract, including those relating to its validity, interpretation, execution, and resolution, the territorial jurisdiction is mandatory for the court of the consumer’s place of residence or domicile.

Online Dispute Resolution for Consumers

Consumer customers residing in the European Union are informed that the European Commission has established an online platform that provides an alternative dispute resolution tool. This platform can be used by European consumers to resolve, out-of-court, any disputes arising from or related to contracts for the sale of goods and services entered into online.
